The combination of incompetence and malign intent is a very, very bad one. I don't actually know what the legal precedents might be, if there is, in fact, a conflict between the legislation from 2010 that created the CFPB and the legislation the WH is using from 1998. It's possible that there are unwritten conventions that have simply been observed because it never occurred to anyone that someone would try to be an autocrat.
Meanwhile, just by sowing confusion as to who is in charge the WH and Tea Party flunkies are undermining an agency that the Wells Fargo debacle alone should prove the value of. Not to mention, if the WH is so hot under the collar to get one of their own in charge, why don't they just appoint someone to replace Cordray and get him (it's highly unlikely to be a her) confirmed? This is stupid, and childish, and anything but governance.
P.S. I guess the GOP is ok with the WH blowing off Congress when they think they are in charge? Like, an imperial presidency is ok, now, I guess? Laws passed by Congress only count if the side in power agrees with them?
