OFFS. You are just suing Williamsville and Amherst because they are the wealthy suburbs next to Buffalo. It is bloody obvious that the paths are steep (although not especially in the area where this person is supposed to have fallen) and there have been signs in the past about it gets slippery because wet because water, although I don't know what's there now. Also? Fall season in place with trees therefore fallen leaves also wet and slippery. Know what there are definitely signs about? No dogs and there's a picture right in the story of someone with a dog. Lawsuit!

Look, he really got hurt and that is terrible, but people, especially the kids his lawyer so inventively imagines, like the pocket park partly because they can climb all over everything. Even the stuff that says don't climb this it's a freaking waterfall you could die. Ok, it doesn't say exactly that. Anyway, the place is often closed in the winter because of ice or snow, but they don't close it just because it's wet. It's a waterfall. Waterfalls spray water.

It probably is open after dark this time of year because of how early the sun sets. I don't think I've ever been there after dark, although the occasional charming vandalism from high school students clearly happens after dark every year. It's a good question as to whether there are lights in the park and how late it stays open. It would be a dangerous place just from a turning your ankle on the gravel paths point of view if there were no lights at all in the dark.

Anyway, I'm sorry someone got hurt, but I think his lawyer went to the media to get attention he hopes to leverage a better settlement out of. The town and village only just got the notice, they haven't even had a chance to have their lawyers and insurance look at the claim. I'm sure they'll offer something and there will be a private negotiation, etc.
