Jeffrey Huo probably it's time for judges to start working 40 hour weeks regardless of backlogs. Let a few hundred or thousand criminals walk because their trial is taking unconstitutionally long and they'll have to start confirming judges again.
Jasper Janssen Actually, what is more likely is that the accused will simply rot in jail longer waiting for trial. Challenges based on the Sixth Ammendment rarely get anywhere - and guess what? Your Sixth Ammendment challenge is going to be stuck in line, too.
You might imagine that the same people content to allow seats to remain vacant unless/until their chosen side gets to nominate the judges to fill the seas, are probably not all that bothered by making the accused rot longer in jail before they get their day in court.
